1. About Motorproof

Motorproof is an online vehicle marketplace operated by Breccs Private Limited (trading as Motorproof), a company registered in England and Wales (Company No. 15139888). Our platform enables private sellers and trade dealers to advertise vehicles for sale, and enables buyers to browse and make contact with sellers. Motorproof operates across England, Scotland, Wales, and Northern Ireland.

Motorproof is a platform only. We are not a vehicle dealer, broker, or party to any transaction between a buyer and a seller. All contracts for the sale and purchase of vehicles are made directly between the buyer and the seller.

2. Acceptance of terms

By accessing or using motorproof.co.uk, you agree to be bound by these Terms of Use. If you do not agree, you must not use this platform. These terms apply to all users including buyers, private sellers, and trade dealers.

3. Eligibility

You must be at least 18 years old to use Motorproof. By registering an account, you confirm that you are 18 or over and that all information you provide is accurate and truthful. Trade dealers must hold a valid business registration in the United Kingdom.

4. Vehicle listings and verification

All vehicle listings on Motorproof are subject to mandatory DVLA verification before going live. Sellers must provide accurate registration details. Motorproof verifies basic vehicle data against DVLA records including make, model, MOT status, and tax status. This verification does not constitute a full vehicle inspection, HPI check, or guarantee of roadworthiness.

If a vehicle fails DVLA verification, the listing will be rejected. Motorproof is not liable for any losses, costs, or expenses arising from a rejected listing.

Sellers are responsible for ensuring that listing content is accurate, complete, and not misleading. False or misleading conduct may breach the Fraud Act 2006, the Digital Markets, Competition and Consumers Act 2024, or other applicable consumer-protection law.

5. Prohibited conduct

You must not use Motorproof to:

List vehicles you do not own or have authority to sell
Provide false, misleading, or incomplete vehicle information
List stolen, cloned, or written-off vehicles without full disclosure
Engage in fraudulent transactions or money laundering in breach of the Proceeds of Crime Act 2002
Harass, threaten, or harm other users
Use automated tools to scrape or extract data from the platform
Impersonate another person or business
Post content that is defamatory, offensive, or illegal
Send spam, phishing, malicious links, or unsolicited commercial messages
Use messages to harass users, facilitate fraud, or evade Motorproof's privacy and safety controls
Attempt to obtain, publish, or distribute another user's private contact details without permission

6. Buyer responsibilities

Motorproof provides DVLA verification as a baseline check only. Buyers are strongly advised to carry out their own due diligence before purchasing any vehicle, including an independent vehicle inspection, a full HPI or vehicle history check, and a physical viewing of the vehicle before payment.

Motorproof is not a party to any sale and accepts no liability for the condition, history, or fitness for purpose of any vehicle listed on the platform. Your statutory rights under the Consumer Rights Act 2015 apply against the seller, not against Motorproof.

7. Dealer subscriptions and payments

Trade dealer accounts require a paid monthly subscription. Subscription fees are charged in advance. Subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for unused portions of a billing period except where required by law.

Motorproof uses Stripe as its payment processor. By subscribing, you agree to Stripe's terms of service in addition to these terms.

8. Finance referrals

Motorproof may display links to third-party vehicle finance providers. Motorproof is not a credit broker, is not authorised or regulated by the Financial Conduct Authority (FCA), and does not provide financial advice. Any finance product is provided by the relevant lender and is subject to the lender's own terms and conditions. You should seek independent financial advice before entering into any credit agreement.

9. Platform liability

Motorproof provides an online marketplace and does not guarantee that listings, users, vehicles, or third-party services will always be accurate, available, safe, or suitable. To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you agreed to these terms, losses caused by matters outside our reasonable control, or business losses suffered by consumers.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms affects a consumer's statutory rights. If we fail to provide the platform with reasonable care and skill, our responsibility will be determined under applicable law.

10. Intellectual property

All content, design, trademarks, and software on Motorproof are owned by or licensed to Breccs Private Limited. You may not reproduce, copy, or distribute any part of the platform without written permission.

11. Account termination

Motorproof reserves the right to suspend or terminate any account that breaches these terms, engages in fraudulent activity, or is used in a manner that is harmful to other users or to the platform. No refund will be issued for the remaining subscription period where termination is due to a breach of these terms.

12. Changes to these terms

Motorproof may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated by email to registered users.

13. Governing law

These terms are governed by the laws of England and Wales. Motorproof is a trading name of Breccs Private Limited, Company No. 15139888, registered in England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable law in Scotland or Northern Ireland requires otherwise.

Partner Advertising Terms

These terms apply to businesses purchasing partner advertising placements on Motorproof ("Partner Advertisers").

Placement and Display

Partner Advertisers purchase placement packages (Starter, Standard, or Featured) for a fixed duration. Placements are displayed on Motorproof pages as described in the package selected at time of purchase. Motorproof reserves the right to adjust placement positions to maintain platform quality and user experience.

Content Standards

All advert content must be accurate, legal, and relevant to the automotive industry. Motorproof reserves the right to remove any advert that is misleading, offensive, or unrelated to automotive products or services without refund.

Payment and Refunds

All payments are processed securely via Stripe. Advertising fees are non-refundable once a placement goes live. If a placement is removed by Motorproof due to content violations, no refund will be issued.

Account Management

A partner advertiser account is automatically created when you complete your first payment. You are responsible for maintaining the security of your account credentials. Motorproof staff will never ask for your password.

Renewal and Expiry

Placements do not auto-renew. You will receive an email reminder 10 days before your placement expires. Expired placements are removed from display automatically. You may renew at any time from your partner dashboard.
